Subotiz is a commerce platform that equips merchants with the tools and technology to provide checkout, billing and payment solutions that handle all aspects of payments of selling virtual goods, i.e. electronically delivered, non-physical products including but not limited to digital content, digital entitlements, digital services and SaaS subscriptions. We do not host merchant stores, list products, or participate in the production or delivery of any goods or services. This Acceptable Use Policy (“AUP”) describes activities that are prohibited in connection with your use of the Services.
The following activities are prohibited or restricted. The type of activities below are representative but not exhaustive. By creating an Account and using our Services to facilitate payment for your goods or services, you confirm that you will not use the Services to process payments related to any of the prohibited business categories or practices listed in this AUP. You remain solely responsible for ensuring that your goods or services comply with all applicable laws and do not fall under any prohibited categories. If you are uncertain as to whether your business is prohibited or restricted business or have questions about how these requirements apply to you, please contact us.
- Physical Products: Physical products or products that require physical delivery.
- Child exploitation: You may not offer goods or services, or post or upload Service Data that exploit or abuse children, including but not limited to images or depictions of child abuse or sexual abuse, or that present children in a sexual manner.
- Harassment, bullying, defamation and threats: You may not offer goods or services, or post or upload Service Data, that harass, bully, defame or threaten a specific individual.
- Hateful content: You may not use the Services to promote or condone hate or violence against people based on race, ethnicity, color, national origin, religion, age, gender, sexual orientation, disability, medical condition, veteran status or other forms of discriminatory intolerance. You may not use the Services to promote or support organizations, platforms or people that: (i) promote or condone such hate; or (ii) threaten or condone violence to further a cause.
- Illegal activities: You may not offer goods or services, or post or upload Service Data, that contravene or that facilitate or promote activities that contravene, the laws of the jurisdictions in which you operate or do business. You may not offer goods or services that violate any rules or regulations of card brand networks and payment gateways partners.
- Intellectual property: Do not infringe the copyrights, trademarks, trade secrets, or other intellectual property rights of any person or entity. You may not use the Services to offer, publish, upload, post or otherwise make available any goods, services, or Service Data without obtaining the prior authorization from the rightful owner.
- Malicious and deceptive practices: You may not use the Services to transmit malware or host phishing pages. You may not perform activities or upload or distribute Service Data that harm or disrupt the operation of the Services or other infrastructure of Subotiz or others, including Subotiz’s third party providers. You may not use the Services for deceptive commercial practices or any other illegal or deceptive activities.
- Personal, confidential, and protected health information: You may not post or upload any Service Data that contain personally identifiable information, sensitive personal information, or confidential information, such as credit card numbers, confidential national ID numbers, or account passwords unless you have consent from the person to whom the information belongs or who is otherwise authorized to provide such consent. You may not use the Services to collect, store, or process any protected health information subject to the Health Insurance Portability and Accountability Act (“HIPAA”), any applicable health privacy regulation or any other applicable law governing the processing, use, or disclosure of protected health information.
- Prohibited and Restricted Items: Means the products, services,contents or Service Data which by applicable law and regulations, are forbidden, or require special licences or permits from a government authority to sell in the region where your store is located and the region where you sell.
- Safety, Security and Well-being: You may not offer goods or services, or post or upload Service Data, that promote self-harm, suicide, disordered eating and body image, animal abuse, harmful practice, dangerous activities or challenges, instructions to kill or harm , dangerous or threatening pranks, graphic, violent, or shocking content.
- Vulgar Language: You may not post or upload Service Data with use of excessive sexually explicit language or narratives, heavy profanity or sexually suggestive terms.
- Spam: You may not use the Services to transmit unsolicited commercial electronic messages. Do not facilitate or cooperate in the dissemination of spam in any way.
- Hacking, Virus and Network Attacks: Do not access any computer or communications system without authorization, including the systems used to provide the Services. Do not intentionally distribute a computer virus, launch a denial of service attack, or in any other way attempt to interfere with the functioning of our Services, any computer, communications system, or website. Do not attempt to access or otherwise interfere with the Accounts of other users of the Services.
- Terrorist organizations: You may not offer goods or services, or post or upload Service Data, that imply or promote support or funding of, or membership in, a terrorist organization.
- Integrity and Authenticity: You may not offer misinformation that may cause significant harm to individuals or society, regardless of intent. Service Data are ineligible if they contain misinformation that may cause harm, such as certain health content, conspiracy theories, repurposed media, or misrepresented authoritative sources. We require you to label AIGC or edited media that shows realistic-appearing scenes or people. Do not offer content that shares or shows fake authoritative sources or crisis events, or falsely shows public figures in certain contexts. We do not allow the trade or marketing of services that attempt to artificially increase engagement.
We may, at any time and without prior notice, remove any Service Data submitted through the checkout interface, and suspend or terminate your Account or access to the Services, if you engage in any activity that violates the letter or spirit of this Acceptable Use Policy (AUP), including conduct outside your use of the Services that we reasonably believe may pose a risk to Subotiz, our users, or our payment partners.
Subotiz has the right, but not the obligation, to monitor or investigate any Service Data and your use of the Services at any time for compliance with this AUP, the Subotiz
Terms of Service, or any other agreement between you and Subotiz governing your use of the Services (collectively, the
“Terms”). Our determination of whether a violation of this AUP has occurred will be final and binding, and any action taken with respect to enforcing this AUP, including taking no action at all, will be at our sole discretion.
Subotiz may modify this AUP at any time by posting a revised version
here. By continuing to use the Services or access your Account after a revised version of the AUP has been posted, you agree to comply with the latest version of the AUP. In the event of a conflict between the AUP and the Terms, this AUP will take precedence, but only to the extent required to resolve such conflict.
Capitalized terms used but not defined in this AUP shall have the meanings set forth in the Term of Service.
